General Terms and Conditions (GTC)

1. Scope of Application
1.1 These General Terms and Conditions (GTC) apply to all contracts concluded via the Habesha Catering Platform (hereinafter "Platform") between Majesty Developers (hereinafter "Provider") and users (hereinafter "Customers").
1.2 The Platform offers catering services for Ethiopian and Eritrean cuisine (Habesha cuisine) in North Rhine-Westphalia, including bookings for events such as weddings, corporate events, and private parties.
1.3 Deviating or supplementary conditions of the Customer are not recognized unless expressly agreed to in writing by the Provider.
2. Conclusion of Contract
2.1 The presentation of catering services on the Platform does not constitute a legally binding offer but an invitation to submit an offer.
2.2 The Customer submits a binding offer by completing and submitting the booking form on the Platform. The contract is formed upon written confirmation (via email) by the Provider.
2.3 Bookings can be made in German or English. The Provider reserves the right to reject bookings without stating reasons.
3. Services of the Provider
3.1 The Provider offers catering services, including the preparation and delivery of food, as described on the Platform (e.g., menus with Injera, Tibs, vegan options).
3.2 Deliveries are limited to North Rhine-Westphalia. Availability depends on the delivery zone and capacity.
3.3 The Provider guarantees compliance with food hygiene regulations pursuant to EU Regulation (EC) No. 852/2004. Allergens are listed in menu descriptions.
4. Prices and Payment Terms
4.1 All prices are in Euros (€) and include statutory VAT. Delivery costs are shown separately.
4.2 Payments are made via bank transfer (SEPA) or integrated payment services (e.g., Stripe). Payment details are provided in the booking confirmation.
4.3 Invoices are payable within 7 days of receipt unless otherwise agreed. In case of late payment, interest of 5 percentage points above the base rate applies.
5. Booking and Cancellation
5.1 Bookings must be submitted at least 48 hours before the event unless a shorter period is agreed.
5.2 Cancellations are free of charge up to 72 hours before the event. For later cancellations, 50% of the agreed price is charged; within 24 hours, 100%.
5.3 Changes to bookings (e.g., number of guests, menu) are possible up to 48 hours before the event, subject to availability.
6. Delivery and Execution
6.1 Deliveries are made at the agreed time to the specified address in NRW. The Customer ensures the delivery address is accessible.
6.2 Delays due to force majeure or unforeseen circumstances (e.g., traffic) do not entitle to compensation unless the Provider acts with gross negligence.
6.3 The Customer checks the delivery upon receipt for completeness and defects. Complaints must be reported immediately.
7. Liability
7.1 The Provider is liable for damages only in cases of intent or gross negligence. Liability for slight negligence is limited to typical, foreseeable damages.
7.2 The Provider is not liable for health issues due to allergies if allergens were correctly disclosed.
7.3 For data loss, the Provider is liable only for gross negligence and up to the cost of data recovery.
8. Data Protection
8.1 The Provider processes personal data (e.g., name, address, email) in accordance with the EU General Data Protection Regulation (GDPR). Details are available in the Platform’s privacy policy.
8.2 Data is used solely for booking processing, delivery, and communication. Customers can request access, correction, or deletion of their data at any time.
8.3 Email notifications (e.g., booking confirmations) are handled via Firebase Functions; data is stored GDPR-compliantly on EU servers.
9. Right of Withdrawal
9.1 Consumers have a 14-day statutory right of withdrawal, provided the catering service has not yet been performed.
9.2 The right of withdrawal expires for customized services (e.g., tailored event menus) or perishable goods (§ 312j (2) BGB).
9.3 A withdrawal policy is available on the Platform.
10. Use of the Platform
10.1 Customers must register with accurate data (via Firebase Auth, email, or Google Sign-In).
10.2 The Platform is available in German and English; users can switch languages. Dark/Light mode is available system-wide.
10.3 The Provider reserves the right to suspend accounts for misuse (e.g., false information).
11. Final Provisions
11.1 The laws of the Federal Republic of Germany apply, excluding the UN Sales Convention.
11.2 The place of jurisdiction for disputes is Düsseldorf if the Customer is a merchant.
11.3 Should any provision of these GTC be invalid, the remaining provisions remain unaffected.
